In order to ensure transparency and give you more control over your Personal Information (as defined below), this privacy notice (“Privacy Notice”) governs  how we, Alta AI Inc. and its affiliated entities (“Alta”, “we”, “our” or “us”) use, collect and store Personal Information that we collect or receive from or about  you (“you”) in connection with https://www.altahq.com/ (“Website”), and the Alta platform, AI agents, products and services (“Services”). 

Please read this Privacy Notice carefully, so you can fully understand our practices in relation to Personal Information. “Personal Data” or “Personal  Information” means any information that can be used, alone or together with other data, to uniquely identify any living human being and any information  deemed as Personally Identifiable Information by privacy laws. Important note: Nothing in this Privacy Notice is intended to limit in any way your statutory  rights, including your rights to a remedy or other means of enforcement. 

Alta’s software is an AI-powered sales automation platform that enhances prospecting, lead engagement, and pipeline management. It integrates with third party tools to optimize outreach and drive revenue growth. Use of the Software is subject to the terms of this Agreement. 

When you are an individual interacting with Alta’s Services, including, the AI agent, Alta may collect and process your Personal Information on behalf of our  customers. We process such Customer Information on behalf of and under the instruction of the respective customer, in accordance with our Data Processing  Addendum with them. Accordingly, this Privacy Notice (which describes Alta’s privacy and data processing practices) does not apply to the privacy and data  processing practices of our customers. You should refer all your questions, comments, and data subject requests to the relevant customers (company that you  are interacting with). For more information, please refer to Section 2 below. 

Our Services are designed for businesses and are not intended for personal or household use. Accordingly, we treat all Personal Information covered by this  Privacy Notice, including information about any visitors to our Website, as pertaining to individuals acting as business representatives, rather than in their  personal capacity. 

This Privacy Notice can be updated from time to time and, therefore, we ask you to check back periodically for the latest version of this Privacy Notice. If we  implement material changes in the way we use your Personal Information, in a manner that is different from that stated at the time of collection, we will notify  you by posting a notice on our Website and/or Services or by other means and take any additional steps as required by applicable law. 

1. WHAT PERSONAL INFORMATION WE COLLECT, WHY WE COLLECT IT, AND HOW IT IS USED 

A. Personal Information You Provide Directly to Us Through the Website (e.g., when you contact us, request a demo, download our e-books,  apply for a job, apply to become an Alta partner). 

(i) Personal Information We Collect: We collect Personal Information that you voluntarily provide, such as full name, (including first and last  name), email address, your company’s work email address, your company’s size, phone number, description of your inquiry, messages,  company name, LinkedIn username, CV and any other information that you decide to provide us with. 

(ii) Purpose For Collecting Your Personal Information: We use your Personal Information

  • for monitoring and/or security purposes;
  • to allow you to apply for a job in Alta;
  • to allow you to apply join the partner program;  
  • to allow you to download our guides in e-books format;  
  • to communicate with you and contact you to obtain feedback from you;  
  • to establish a business relationship with you; 
  • to send you marketing communications;  
  • to provide you with support;  
  • to process and answer your request for a demo;  
  • to answer your questions; 
  • to allow you to communicate with us;  
  • to analyze your use of our Website and to improve our Website; and 
  • to customize your experience. 

(iii) Legal Basis (GDPR only, if applicable): Depending on the case, processing is necessary for the performance of a contract to which the data  subject is party or in order to take steps at the request of the data subject prior to entering into a contract; legitimist interest (e.g., to answer  your questions, or to provide you the demo that you requested); and/or consent (e.g., for marketing purposes). 

(iv) Consequences For Not Providing Personal Information: We will not be able to monitor and ensure security of our Website; allow you to apply  for a job; allow you to apply to join the partner program; allow you to download our guides; communicate with us or provide us with feedback;  establish a business relationship; send you marketing communications; provide you with support; provide you with a demo; answer your  questions; allow you to communicate with us; analyze your use of our Website; improve our Website or customize your experience with the  Website and Alta.  

B. Personal Information that Customers Provide Us Through the Services (e.g., when you register, sign-in and make use of Alta Services). (i) Personal Information We Collect:  

(a) We collect Personal Information that you voluntarily provide us in order to open an account and/or sign up to the Services, such as your  log-in details (including third party credentials “Google”), passwords, and any other category of Personal Information you decide to provide  us with.  

(b) We automatically collect certain information through your use of the Services, such as your Internet protocol (IP) address, cookie identifiers  and other device identifiers that are automatically assigned to your device, browser type and language, geo-location information, hardware  type, operating system, internet service provider and other Personal Information about actions taken through the use of the Services. (ii) Purpose For Collecting Your Personal Information: We use your Personal Information 

  • to allow you to open an account, register and log-in to the Services;  
  • to send you notifications and/or emails and regarding your account or certain updates or features of the Services (e.g., in order to  authenticate your identity);
  • to facilitate, operate, enhance and provide the Services;  
  • to test and monitor the Services and to provide support services; 
  • to gain better understanding on how you interact with our Services and remember your preferences; 
  • to generate aggregated data, statistics, derive non-identifiable information, and/or transform data into aggregated or de-identified formats; 
  • to improve, enhance, and optimize our Services; 
  • to customize your experience; 
  • to send you marketing communications and materials; 
  • to allow you to send us feedback; 
  • to monitor your usage of the Services; and 
  • to enforce our contract.  

(iii) Legal Basis (GDPR only, if applicable): Depending on the case, processing is necessary for the performance of a contract which the data subject  is party or in order to take steps at the request of the data subject prior to entering into a contract (e.g., to create the account and provide the  Services); legitimist interest (e.g., to monitor your usage of the Services, to aggregate information) and/or consent (e.g., for marketing purposes). 

(iv) Consequences For Not Providing Personal Information: We will not able to allow you to register for and log-in to our Services; provide and  operate the account; provide you with the Services; monitor and secure the following purposes, including, without limitation, for user  authentication, logging and debugging; provide support; improve, enhance, and optimize our Services; customize your experience; allow you  to send us feedback; and send you marketing communications. 

C. Personal Information we Automatically Collect When You Browse Our Website: 

(i) Personal Information We Collect: We automatically collect certain information through your use of the Website, such as your Internet protocol  (IP) address, cookie identifiers and other device identifiers that are automatically assigned to your device, browser type and language, geo location information, hardware type, operating system, internet service provider and other Personal Information about actions taken through  the use of the Website. 

(ii) Purpose For Collecting Your Personal Information: We use such information to analyze use trends of the Website, maintain and improve the  functionality of the Website, and for advertainments purposes. 

(iii) Legal Basis (GDPR only, if applicable): Legitimate interest (e.g., essential cookies required for the operation of the Website) or consent (e.g.,  non-essential cookies, to the extent required under applicable law). 

(iv) Consequences For Not Providing Personal Information: Certain part and features of the Website may not be available to you. 

D. When You Attend a Marketing Event, Exchange Business Cards with Us or Otherwise Provide Us with Your Personal Data for Marketing  Purposes

(i) Personal Data we may collect: Full name, business email address, job title, business address and phone number, as well as any other Personal  Information you decide to provide us with. 

(ii) For what purposes: To establish a business relationship with you, contact you about our Services and send you marketing communications. (iii) Legal basis (GDPR only, if applicable): Depending on the context, legitimate interest or consent. 

(iv) Consequences of not providing the Personal Data: We will not be able to establish a business relationship or send you marketing  communications. 

E. When We Acquire Your Personal Data from Third-Party Sources

(ii) For what purposes: to establish a first business connection and to send marketing communications.

(iv) Consequences of not providing Personal Information 

Finally, please note that some of the Personal Information, including Customer Information will be used for detecting, taking steps to prevent, and prosecution  of fraud or other illegal activity, to identify and repair errors, to conduct audits, and for security purposes. Personal Information may also be used to comply  with applicable laws, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims. In certain  cases, we may anonymize or de-identify your Personal Information. “Aggregated Information” means information which does not enable identification of an  individual user, such as aggregated information about the use of our Services. We may use Aggregated Information and/or disclose it to third parties for our  business purposes and further use such anonymized data for internal business purposes, including, without limitation, to improve, enhance, and optimize our  models (proprietary models or third-party models), fine-tuning models, algorithms, platform and Services and for research and development purposes. 

2. CUSTOMER INFORMATION 

A. For the avoidance of doubt, Alta is processing Customer Information (as defined below) on behalf of the applicable customer. Therefore, the customer  is the party responsible for the security, integrity and authorized usage of Customer Information in the context of the Services and also for obtaining  consents, permissions and providing any required data subject rights and fair processing notices required for the collection and usage of such Customer  Information. The customer is the sole responsible to ensure that the use of the Services is permitted under the applicable laws and jurisdictions.  

B. Alts has a contractual relationship with its customers. In the context of Alta’s Services, the customer can decide which Personal Information name,  email address, messages, recording of the conversations and calls made via the AI Agents (“Customer Information”) will be collected, processed and  shared with Alta and the Services. Customer Information is not regulated by this Privacy Notice, and this paragraph is provided only for transparency  purposes, since Alta is a data processor/service provider of the Customer Information. If you have any questions related to the Customer Information,  please contact the customer directly.  

3. HOW WE PROTECT AND RETAIN YOUR PERSONAL INFORMATION 

A. Security. We implement and maintain industry-standard technical, organizational and security measures designed to protect your Personal Information.  However, please note that we cannot guarantee that the Personal Information will not be compromised as a result of unauthorized penetration of our  servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the  security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information. 

B. Retention of your Personal information. Your Personal Information will be stored until we proactively delete it from our records, or until you send a  valid deletion request. Please note that in some circumstances we store your Personal Information for longer periods of time, for example (i) where we  are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with  us in the event of any complaints or challenges, and/or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Information  or dealings. 

4. HOW WE SHARE YOUR PERSONAL INFORMATION 

We may share your Personal Information as follows:  

A. The Personal Information Alta gathers may be shared with our partners and other third parties.  

B. We use third party service providers to process your Personal Information for the purposes outlined above, including, without limitation: (a) With cloud service providers for hosting purposes; 

(b) With websites and web content creation and management platforms in order to help us operate our Website; 

(c) With email providers, marketing, lead generation, CRM, calendar tool, other similar tool providers;  

(d) With AI tools, services and features; and

(e) With cookies and analytic companies, in order to improve, enhance, protect, promote and help us understand and analyze information we collect  in accordance with this notice. 

C. We also share Personal Information about you with our affiliated companies. 

D. To the extent necessary, with regulators, courts, banks or competent authorities, to comply with applicable laws, regulations and rules (including,  without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by  court order, as well as for internal compliance procedures and to protect the safety, security, and integrity of Alta, our Services, customers, employees,  property, and the public. We may use or disclose the Personal Information we collect in order to ensure that our users are complying with all applicable  aspects of our policies. 

E. We may disclose Personal Information with our lawyers, accountants, auditors and other professional advisors where necessary to obtain legal or other  advice or otherwise protect and manage our business interests. 

F. We may use or disclose the Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, cybersecurity  threats, situations involving potential threats to the physical safety of any person, violations of this notice, or as otherwise required or allowed by law  and regulations. 

G. If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose  your Personal Information to such third party (whether actual or potential) in connection with the foregoing events (including, without limitation, our  current or potential investors). In the event that we are acquired by, or merged with, a third-party entity, or in the event of bankruptcy or a comparable  event, we reserve the right to transfer, disclose or assign your information in connection with the foregoing events. 

H. Where you have otherwise provided your consent to us for sharing or transferring your Personal Information. 

5. YOUR PRIVACY RIGHTS 

A. The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to  individuals protected by the GDPR): 

(a) You have the right to withdraw consent to the processing, where consent is the basis of processing. Please note that the withdrawal of consent  shall not affect the lawfulness of processing based on consent before its withdrawal. 

(b) You have the right to request access to your Personal Information held by us, along with details on how it is processed, subject to certain  conditions. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate  administrative fee where permitted by applicable law 

(c) You have the right to demand rectification of inaccurate Personal Information about you. We will promptly correct any Personal Information  found to be incorrect. 

(d) You have the right to object to unlawful data processing under certain conditions. 

(e) You have the right to the erasure of past Personal Information about you (your “right to be forgotten”) under certain conditions. Please note  that there may be circumstances in which we are required to retain your Personal Data, for example for the establishment, exercise or defense  of legal claims; 

(f) You have the right to demand that we restrict the processing of your Personal Information, under certain conditions, if you believe we have  exceeded the legitimate basis for processing, the processing is no longer necessary, or if you believe your Personal Information is inaccurate. (g) You have the right to data portability of Personal Information concerning you that you provided us in a structured, commonly used, and  machine-readable format, subject to certain conditions. 

(h) You have the right to object to profiling. 

B. You can exercise your rights by contacting us at info@altahq.com. You may use an authorized agent to submit a request on your behalf if you provide  the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request.  Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable  law or inform you if we need further information in order to fulfill your request. When processing your request, we may ask you for additional  information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge  a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect  the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your  request in a different way than requested, we will address your request to the maximum extent possible, all in accordance with applicable law.  

You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place  of alleged infringement) at any time. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority. C. Deleting your account: Should you ever decide to delete your account; you may do so by emailing info@altahq.com. If you terminate your account,  any association between your account and Personal Information we store will no longer be accessible through your account.  D. Marketing emails – opt-out: You may choose not to receive marketing emails of this type by using the unsubscribe link found at the bottom of the  email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt. 

6. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION 

A. In order to run our business and provide our Website, and Services to you, we transfer Personal Information to certain countries around the world,  including to our affiliates and service providers, many of whom are located outside of your jurisdiction. Therefore, your Personal Information may be  processed in countries with privacy laws that are different from privacy laws in your country. Whenever Personal Information is transferred  internationally, we ensure it is protected by using Standard Contractual Clauses or other lawful mechanisms: 

(a) making sure the destination country has been deemed by the European Commission to provide an adequate level of protection for Personal  Information; and/or 

(b) by executing data onward transfer instruments such as data processing and protection agreements. 

7. USE BY CHILDREN.

We do not offer our products or services for use by children and, therefore, we do not knowingly collect Personal Information from,  and/or about children under the age of 18. If you are under the age of 18, do not provide any Personal Information to us without the involvement of a parent  or a guardian. In the event that we become aware that you provide Personal Information in violation of applicable privacy laws, we reserve the right to delete  it. 8. INTERACTION WITH THIRD PARTY PRODUCTS.

We enable you to interact with third party websites, mobile software applications and products  or services that are not owned, or controlled, by us (each, a “Third Party Service”). We are not responsible for the privacy practices or the content of such  Third Party Services. Please be aware that Third Party Services can collect Personal Information from you. Accordingly, we encourage you to read the terms  and conditions and privacy policies of each Third Party Service. We confirm that Google Workspace APIs are not used to develop, improve, or train  generalized AI and/or machine learning models. 

9. ANALYTIC TOOLS/COOKIES 

A. Google Analytics. The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects  information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to  this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the  information collected through the use of Google Analytics with information we collect. Google’s ability to use and share information collected by  Google Analytics about your visits to this Website is restricted by the Google Analytics Terms of Service, available at  https://marketingplatform.google.com/about/analytics/terms/us/, and the Google Privacy Notice, available at http://www.google.com/policies/privacy/.

B. FullStory. If you are a visitor of our Website, FullStory collects information on your use of the Website, such as pages visited, links clicked, non sensitive text entered, and mouse movements, as well as information more commonly collected such as the referring URL, browser, operating system,  and Internet Protocol address. FullStory uses publicly available sources to approximate your geographic region and Internet Service Provider based on  your IP address. C. Hotjar. We use Hotjar to help us understand how visitors interact with our Website and to improve user experience. Hotjar collects information such as pages visited,  actions taken, and device information, but does not collect personal data that directly identifies you. D. Calendly. We use Calendly on our Website to facilitate appointment scheduling and to enhance your experience. As part of this service, Calendly may  collect information about your visit, such as your device and browsing activity, to help us manage bookings and improve our services. E. We reserve the right to remove or add new analytic tools, cookies, pixels and other tracking technologies.
